WxYapper Terms of Use

These Terms of Use ("Terms") govern your access to and use of wxyapper.com, theWxYappermobile web experience, and related services (collectively, the "Service"). The Service is operated by Cardinalis Web Development("we," "us," or "our").

By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

WxYapper provides weather information for locations in the United States, including current conditions, forecasts, radar, and plain-language summary briefings. The Service may include optional account features, event outlook tools, and third-party advertising on certain pages. We may add, change, or discontinue features at any time.

The Service is intended for users who are at least 13 years of age. The Service is designed for users in the United States. If you use the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

If you create an account, you agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity under your account.

We may suspend or terminate your account if we reasonably believe you have violated these Terms or used the Service in a harmful or unlawful manner. You may delete your account at any time through account settings.

You agree not to misuse the Service. Without limitation, you may not: scrape or harvest data from the Service at scale without our written permission; attempt to reverse engineer, disrupt, or overload our systems; circumvent access controls; use the Service for unlawful purposes; or interfere with other users' access to the Service.

Forecast and observation data displayed in the Service is derived from the National Weather Service and other third-party sources. WxYapper also presents automated, plain-language forecast summaries based on NWS Area Forecast Discussions and grid forecast context.

Weather information may be delayed, incomplete, or contain errors. Summaries are interpretive and may not reflect the latest official forecast for your exact location.

The Service is not intended for life-safety decisions. Do not rely on WxYapper as your sole source of weather information during hazardous weather. Always follow National Weather Service watches, warnings, and advisories, and instructions from local emergency officials. NWS data is public-domain information; we add original presentation, formatting, and editorial summaries on top of that data.

The WxYapper name, logo, website design, software, and original summary text are owned byCardinalis Web Development or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, or distribute our proprietary materials except as permitted by these Terms or with our prior written consent. We preserve NWS and NOAA attribution where required.

The Service relies on third-party providers including hosting infrastructure, analytics (Google Analytics), and advertising (Google AdSense). Your use of those services may be subject to the third parties' own terms and privacy policies. We are not responsible for third-party websites or services linked from the Service.

Third-party advertisements may appear on certain forecast pages. Ad content is provided by third-party vendors and does not constitute an endorsement by WxYapper or Cardinalis Web Development. See our Privacy Policy for information about advertising cookies and your opt-out choices.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.

TO THE FULLEST EXTENT PERMITTED BY LAW, CARDINALIS WEB DEVELOPMENT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify and hold harmless Cardinalis Web Developmentand its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We may update these Terms from time to time. When we do, we will revise the Effective Date at the top of this page. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles. You agree that exclusive jurisdiction for disputes relating to these Terms or the Service lies in the state or federal courts located in Wisconsin, and you consent to personal jurisdiction in those courts.
